Although not constitute the mainstream of English Law, special
consideration must be given to the Court of Justice of the
European Communities (the European Court), because its judgments
become part of English law, and in the sphere in which it
operates it is superior even to the House of Lords.
The Treaty of Rome provides that any court in a member state
from which there is no right of appeal – which in the
UK is the House
of Lords – and which has before it a case concerned
with the meaning of any of the European treaties must suspend
the case and remit it to the European Court for a preliminary
ruling on the meaning of the treaty, unless the matter has
already been decided by the European Court.
