Conditional and absolute discharge
Sometimes the court may feel that there are special circumstances
which justify failure to impose a penalty despite the fact that
a person has been found guilty, or it may be felt that the prosecution
ought not to have been brought. In such circumstances the offender
may be granted either a conditional discharge, the condition
being that he does not commit any similar offence during a prescribed
period not exceeding three years, or an absolute discharge,
which has no conditions attached. If a person commits a further
offence during the period of a conditional discharge, he may
be sentenced for the original offence as well as for the further
offence.
Deferral of sentence
With the consent of the defendant, the court may defer sentence
for a period of six months to find out how the defendant behaves,
for example, whether he makes any reparation in respect of
his offence. If he is of good behaviour during the period
of deferral the court may then impose a lenient sentence such
as a conditional discharge.
